Scope of Application
These General Terms and Conditions apply to all contractual relationships between Skywalk GmbH & Co. KG and its customers through the FLYSURFER online shop.
They apply to:
• consumers
• merchants and entrepreneurs
Conflicting or deviating customer terms do not become part of the contract, even if Skywalk does not explicitly object to them.
The version valid at the time of the order applies.

Conclusion of Contract
Contracts may be concluded in German or English. Product presentations in the online shop do not constitute legally binding offers. By placing an order, the customer submits a binding offer to purchase the selected products.
The contract is formed only upon:
• separate order confirmation
• dispatch of the goods
If ordered goods are unavailable, Skywalk reserves the right not to accept the order. Payments already received will be refunded immediately. Skywalk reserves the right not to accept an order if there are reasonable concerns regarding the customer’s ability to handle the products safely.
Right of Withdrawal
Consumers have a statutory right of withdrawal of fourteen days. The withdrawal period begins when the customer, or a third party named by the customer, receives the goods.
To exercise the right of withdrawal, the customer must send a clear declaration to:

Consequences of Withdrawal
Refunds will be made within fourteen days after receipt of the withdrawal notice. The customer bears the direct cost of returning the goods. Skywalk may withhold the refund until the goods have been received or until the customer has provided proof of return.
The right of withdrawal does not apply to:
• custom made or personalized goods
• sealed goods that are not suitable for return once opened
• goods that have been inseparably combined with other items after delivery
Prices and Shipping
All prices are gross prices including VAT, unless otherwise stated. Shipping costs are shown separately during checkout. The prices valid at the time of ordering apply.
Delivery, Transportation and Transfer of Risk
For consumers, risk transfers upon handover of the goods to the customer. For entrepreneurs, risk transfers upon handover of the goods to the transport company. Unless otherwise agreed, delivery is made from our warehouse to the address provided by the customer.
Estimated delivery times:
• Germany: approx. 3 to 5 business days
• EU: approx. 10 to 14 business days
Customers outside the EU are responsible for customs clearance costs, import duties and other charges that may apply. Partial deliveries are permitted if reasonable for the customer.
Payment
Payment may be made using the payment methods shown during checkout.Payment is due immediately upon conclusion of the contract, unless otherwise stated. Offsetting or retention is only permitted if the customer’s counterclaims are undisputed or legally established.
Retention of Title
Goods remain the property of Skywalk until full payment has been received. The customer must treat the goods with care until ownership has transferred.
In commercial transactions:
• the customer may resell goods in the ordinary course of business
• claims from resale are assigned to Skywalk in advance
• Skywalk may revoke collection authorization in case of default
• processing or transformation of the goods is carried out on behalf of Skywalk as manufacturer
Warranty
Skywalk warrants that goods are free from defects at the time of delivery in accordance with applicable statutory provisions. Entrepreneurs must inspect goods immediately after delivery and notify defects in writing within two weeks.
Warranty periods:
• Consumers: 2 years
• Entrepreneurs: 1 year
• Used goods for consumers: 1 year
• Used goods for entrepreneurs: no warranty, unless otherwise agreed
Manufacturer warranties apply in addition, where available. In case of defects, consumers may choose repair or replacement. For entrepreneurs, the choice of remedy lies with Skywalk. If subsequent performance fails, the customer may reduce the price or withdraw from the contract, except in the case of insignificant defects.
Use of FLYSURFER Products and Assumption of Risk
By purchasing and using FLYSURFER products, the customer acknowledges that kitesurfing, snowkiting, wingfoiling and other wind powered sports involve inherent risks. The customer is responsible for using the products safely, following all instructions, checking the equipment before use and considering weather, spot, skill level and local regulations.
To the extent legally permissible:
• claims related to improper or unsafe use of FLYSURFER products are excluded
• the customer agrees to indemnify Skywalk against third party claims arising from improper product use
Liability for damage to life, body or health resulting from intent or negligence remains unaffected. Liability under the German Product Liability Act remains unaffected.
These provisions also apply to heirs and legal representatives.
Copyright
All photographs, films, graphics, texts and other content on the website remain the property of Skywalk or the respective rights holders. Use without explicit permission is prohibited.
Data Protection
Details regarding the processing of personal data are available in the Privacy Policy.
Choice of Law
German law applies, excluding private international law and the United Nations Convention on Contracts for the International Sale of Goods. For EU consumers, mandatory consumer protection laws of their country of residence remain unaffected.
Place of Jurisdiction

Consumer Dispute Resolution
Skywalk is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
Final Provisions
Skywalk reserves the right to amend these Terms and Conditions. If any provision is invalid, the remaining provisions remain unaffected.
